Council Conclusions on SIS II 2004

1. In 2001 the Council adopted Council Regulation (EC) N° 2424/2001 and Council Decision 2001/886/JHA on the development of SIS II. Following a feasibility study, the Commission has launched a call for tender for the development of SIS II. It is planned to sign the contract with the chosen tenderer in September 2004. This is in line with the schedule to implement the second generation of the SIS by early 2007.

2. In order to adhere to the above plan, it is necessary that the Council clearly define the functional requirements to be included in SIS II at an early stage. In that context the JHA Council Conclusions of 5/6 June 2003 directed that relevant Working Groups consider the functional requirements to be included in SIS II and to bring forward proposals in sufficient time so as not to impact on the delivery date for SIS II. In addition, a Commission Communication on the development of SIS II published in December 2003 indicated that the list of SIS II functions should be finalised by June 2004.

3. The Presidency has prepared a set of draft Council Conclusions with respect to the functions to be provided in SIS II. These draft Conclusions seek to identify all the functions to be incorporated in the new system with reference, where applicable, to earlier decisions and instruments. They are based on discussions in the SIS/SIRENE Working Group on 4 February,

3 March and 2 April 2004 and in the Article 36 Committee on 19 April 2004 and 27 May 2004.

4. The Mixed Committee at the level of Senior Officials considered the draft Council Conclusions set out in document 10004/04 SIRIS 65 COMIX 370 in its meeting of 3 June 2004 and, subject to certain amendments, reached agreement on the text.

5. On this basis COREPER is invited to request the Council to approve the Council Conclusions as set out in annex.
