The Article includes a comparative analysis of the principle of ’open justice’ in several common law countries including the United States, Australia, Canada and the United Kingdom. The Article also features an analysis of the role of the media in court as well as an evaluation of how balancing exercises (open justice vs. fair trail) should be conducted in practice.
