Last Friday 27th May 2005, the European Commission presented a Communication on the mutual recognition of judicial decisions in criminal matters and the strengthening of mutual trust between Member States, featuring its strategy for the implementation of one of the Hague programme’s goals.
The action plan is thus highlighting two main set of interventions: one is aiming at strengthening the mutual recognition, taking into account both the pre-trial stage (collecting of evidence, control measures) and the final decision (mutual information on convictions, principle of ne bis in idem, criminal penalties enforcement, disqualifications); the other is more broadly considering a series of legislative and operational measures that should grant progressive approximation of criminal procedures, common minimum standards in public prosecutions and greater training of legal practitioners in order to ultimately create a «European judicial culture».
A comprehensive working agenda, detailing objectives, methods and timing for Commission’s proposals, is presented in the Annex. Accordingly, the Commission has set a dense pattern of work-in-progress up to 2008, with most of the initiatives already taken or still to be proposed throughout 2005.
