Terrorismo e Guerra : l’alternativo del diritto

In this article, the legal theorist Luigi Ferrajoli analyses the importance of the relation to the legal order in the differentiation between police-operations and military operations. Whereas police-operations can claim a symbolic superiority on criminal activity (by claiming to act in the name of the law), military operations pre-suppose a symbolic equality and hence a risk of perpetuating the violence because of its inherent incapacity to legitimise its violence. This article raises the crucial question of the relations between military activity and the rule of law.
