    Data protection is one of the main issues of the development of the European Area of Freedom, Security and Justice (AFSJ). Indeed, the introduction of measures that touch upon data protection is coupled with growing dilemmas on how to best ensure individuals’ fundamental rights. Is the current legislation on data protection adequate to the challenges posed by specific technologies and specific policies?
  • A Model ‘Prêt-à-Exporter’? The 2008 German–US Agreement on Data Exchange

    A growing number of security policies are based on access to and exchange of personal data, frequently with an international scope. While transatlantic measures generally include the EU as a single actor, the last two years have seen a proliferation of bilateral agreements between the US and individual EU member states. These agreements usually seek to extend abroad a range of specific, internal security measures.
  • Data protection from a transatlantic perspective: the EU and US move towards an international data protection agreement?

    Recent years have been marked by a growing demand of personal data for public security purposes. Access and protection of those data are climbing the transatlantic political agenda. They have raised tensions and fostered forms of cooperation. The possible conclusion of an international binding agreement on a common transatlantic framework on data protection would be a further and crucial step ahead. The scope of this study is to pave the way for launching a parliamentary debate on those issues.
