The relation between liberty and security has been highly contestable over the past 10 years in the EU integration process. With the expansion of the EU’s powers into domains falling within the scope of the Area of Freedom, Security and Justice, liberty and its relation to security has brought a new range of issues, struggles and debates. Acts of political violence labelled as ‘terrorism’ and human mobility at the European and international levels have justified the construction of these phenomena as threats to the security and safety of the nation state. They have legitimised the development of normative responses that go beyond traditional configurations and raise fundamental dilemmas for the security and liberty of the individual.

This working document offers a conceptual framework for understanding the processes underpinning the external dimension of EU Justice and Home Affairs (ED-JHA). Practically, it defines how the export of JHA principles and norms inform the geopolitical ambitions of the EU, i.e. the use of space for political purposes, or the control and management of people, objects and movement. The author begins by investigating how the ENP reconfigures the ED-JHA, and then goes on to discuss various conceptual stances on governance, specifically institutionalism, constructivism, and policy instruments.

Ce briefing paper ad hoc offre un résumé actualisé des implications de la politique européenne de voisinage (PEV) dans le domaine de la justice et des affaires intérieures. Et ce de trois manières : premièrement, il fournit une présentation détaillée des dispositions relatives à la gestion des frontières communes, au contrôle de l’immigration illégale et à la politique des visas. Deuxièmement, le document examine le contenu et les effets des politiques et outils de l’UE lorsqu’ils concernent les contrôles aux frontières. Troisièmement, et finalement, le document pèse le pouvoir du Parlement européen dans les domaines examinés, en s’axant sur les accords de réadmission. This ad hoc briefing paper offers an up to date account of the implications of the European Neighbourhood Policy (ENP) in justice and home affairs. It does so in three ways: First, it provides a comprehensive presentation of the provisions on common management of borders, control of illegal migration and visa policy. Second, the paper discusses the content and effects of EU policies and tools as they related to border controls. Third, and finally, the paper weights the power of the European Parliament in the fields discussed, by focusing on readmission agreements. Each chapter offers a set of policy recommendations.

Le projet à l’oeuvre dans la politique européenne de voisinage ne se situe pas dans la direction où l’on songerait spontanément à le localiser. Sans doute la volonté de créer un cercle d’amis est-elle importante. Mais il y a en creux d’autres logiques, plus diffuses, que seule une lecture serrée des textes permet de débusquer. En sus de la prospérité, nous tenterons de montrer que la « frontiérisation » et la quête de la différence sont les points géométriques privilégiés de la politique européenne de voisinage.

The purpose of this policy brief is to examine the implications of the Treaty of Prüm, focusing on its goals and instruments. It is organised into three sections. The first of these seeks to analyse the rationale of the Treaty by contrasting it with the development of the Schengen Convention. Section 2 studies the legal basis of the Treaty of Prüm in order to assess to what extent was enhanced cooperation considered a viable option for the signatories of the Treaty of Prüm. Finally, section 3 investigates the institutional and substantive consequences of the Treaty.

On 27 May 2005, seven EU Member States signed an agreement in the German city of Prüm which marks a new step in cooperation in justice and home affairs. The signatory states to the Prüm Treaty are: Belgium, Germany, Spain, France, Luxembourg, Netherlands and Austria. The objective of the Treaty is to ‘further development of European cooperation, to play a pioneering role in establishing the highest possible standard of cooperation especially by means of exchange of information, particularly in combating terrorism, cross-border crime and illegal migration, while leaving participation in such cooperation open to all other Member States of the European Union’.

This policy brief presents and critically discusses the content of the Common Consular Instructions (CCI). In this context, the aim of the paper is therefore to offer an analysis of CCI which covers a broad range of aspects, including their operability, their coherence, as well as the technical, legal and political problems they raise. The policy brief then proceeds to address three main sets of questions: What are the technical issues related to the CCI? What are the legal problems related to CCI? What are the political problems related to CCI? Throughout, a particular emphasis is put on the proposed amendments of CCI and their potential impact on individual rights.

From the point of view of both migration and asylum policy and the fight against terrorism, Justice and Home Affairs (JHA) is a key policy area. It is also an area that poses important challenges and raises questions with regard to the preservation of fundamental freedoms. This volume looks at the emerging European Union (EU) area of freedom, security and justice at a time when key policy priorities are taking shape within the EU.
