The mutual recognition (MR) principle was presented at the Tampere European Council in 1999 as the «cornerstone» of the European judicial area and confirmed in the draft Constitution, and its vital importance is recognised in the Hague Programme, which links its development to enhanced mutual trust between the Member States. (...) This communication is part of the Commission’s general process of drawing up a plan of action to give effect to the Hague Programme. It maps the general prospects for the five years ahead (cf. SEC(2005) 641 ), though it specifically stresses the initial implementation period (2005-07), given that there will have to be a mid-term review when the Constitution comes into force. And as the Hague Programme emphasised the importance of evaluating the implementation of policies, the results of the evaluation undertaken here will have to be taken into account and may even inspire changes to the agreed priorities.

The European Commission agreed last Tuesday 10th May 2005, a 5 year Roadmap in order to strengthen the implementation of an area of Freedom, Security and Justice in the EU. Through the adoption of this Action Plan the Commission is thus giving concrete shape and prospective working schedule to the political agenda of The Hague Programme, endorsed by the European Council in November 2004. In this framework, the Action Plan identifies ten specific priority areas for intervention, ranging from EU action on terrorism, migration management, visa policies, asylum, privacy and security, up to the fight against organized crime and criminal justice. This ambitious program has to be completed according to a tight timetable, contained in the Annex of the Action Plan, which sets the adoption of a great variety of Commission’s proposals. The countdown for taking up material action has already started for Brussels Officials and the European Commission will be already issuing its first annual report on the implementation of these measures by the end of 2005. A revision of the indicated measures may occur in the programmed November 2006 mid-term review session.

La Commissione europea ha adottato una proposta di regolamento relativa a un sistema di informazione sui visti (Visa Information System - VIS) e lo scambio di dati tra Stati membri sui visti di breve durata. Il VIS sarà un sistema per lo scambio di dati sui visti tra gli Stati membri e quindi uno strumento di primaria importanza della strategia comune in materia di visti. Esso agevolerà anche i controlli alle frontiere esterne e all’interno degli Stati membri, l’applicazione del regolamento «Dublino» volto a determinare lo Stato membro competente per l’esame di una domanda d’asilo e l’individuazione e il rimpatrio degli immigranti illegali. Il VIS comprenderà una banca dati centrale europea che sarà collegata ai sistemi nazionali per permettere ai consolati e alle altre autorità competenti degli Stati membri di consultare i dati sulle domande di visto e le decisioni prese fino a quel momento.

Die Europäische Kommission hat einen Vorschlag für eine Verordnung über das Visa-Informationssystem (VIS) und den Austausch von Daten über Visa für einen kurzfristigen Aufenthalt zwischen Mitgliedstaaten angenommen. Das VIS stellt als System für den Austausch von Visa-Daten zwischen Mitgliedstaaten primär ein Instrument zur Förderung der gemeinsamen Visapolitik dar. Es wird aber auch Kontrollen an den Außengrenzen und innerhalb der Mitgliedstaaten, die Anwendung der Verordnung «Dublin» zur Bestimmung des für die Prüfung eines Asylantrags zuständigen Mitgliedstaats und die Identifizierung und Rückführung illegaler Einwanderer erleichtern. Das VIS soll eine zentrale europäische Datenbank umfassen, die mit den nationalen Systemen verbunden ist, damit Konsulate und sonstige zuständige Behörden der Mitgliedstaaten Daten über Visumanträge und die diesbezüglichen Entscheidungen in das System eingeben und daraus abrufen können.

The European Commission has adopted a proposal for a Regulation concerning the Visa Information System (VIS) and the exchange of data between Member States on short-stay visas. The VIS will be a system for the exchange of visa data between Member States and thus primarily an instrument to support the common visa policy. It will also facilitate checks at the external borders and within the Member States, the application of the ‘Dublin’-Regulation determining the Member State responsible for examining an asylum application and the identification and return of illegal immigrants. The VIS shall be composed of a European central database, which will be connected to the national systems to enable consulates and other competent authorities of the Member States to enter and consult data on visa applications and the decisions taken thereto.

La Commission européenne a adopté une proposition de règlement concernant le système d’information sur les visas (VIS) et l’échange de données entre les États membres sur les visas de court séjour. Le VIS sera un système d’échange d’informations en matière de visas entre les États membres et offrira un instrument destiné à soutenir la politique commune en matière de visas. Il facilitera également les contrôles aux frontières extérieures et dans les États membres, l’application du règlement de «Dublin» relatif à la détermination de l’État responsable de l’examen d’une demande d’asile ainsi que l’identification et le retour des personnes en situation irrégulière. Le VIS comportera une base de données centrale européenne, connectée aux systèmes nationaux, qui permettra aux consulats et aux autres autorités compétentes des États membres de saisir et de consulter des données sur les demandes de visas et les décisions y relatives.

The present report will therefore be limited to an objective evaluation of the activities of the EURODAC Central Unit. Following a detailed description of the established system, the factual data produced during the first year of activity will be highlighted and analysed. The Central Unit will be evaluated, in the light of its costeffectiveness, the quality of its service and its respect for data protection regulations.

When progressively establishing an area of freedom, security and justice, the European Union shall ensure the free movement of persons and a high level of security. In this context, top priority has been given to the development and establishment of the Visa Information System (VIS) as a system for the exchange of visa data between Member States, which represents one of the key initiatives within the EU policies aimed at supporting stability and security.

In December 2003, the European Council asked the Presidency and SG/HR, in co-ordination with the Commission to present concrete proposals for the implementation of the European security strategy in four areas including the fight against terrorism (para. 85) The Commission welcomes the opportunity to contribute to the further development of EU policy in the fight against terrorism, also in the light of the terrorist atrocities in Spain on 11 March 2004. As recognised in the ESS, terrorism is not a threat which can be tackled by purely military means. Other policies can and do have a role to play.
