  In conformity with Article 3 (e) of Committee of Ministers Resolution (99) 50, on the Council of Europe Commissioner for Human Rights, I made an official visit to Spain from 10 to 19 March 2005 with a view to preparing a report on the effective respect for human rights were upheld in that country. It was my first official visit of a general nature to Spain, as the previous one, which I made on my own initiative from 5 to 8 February 2001, had been limited to the Basque Country, for the specific purpose of observing the situation generated by the violation of human rights as a consequence of terrorist violence (CommDH(2001)2).

  De conformidad con el Artículo 3 (e) de la Resolución (99) 50 del Comité de Ministros (99) 50, relativa al Comisario de Derechos Humanos del Consejo de Europa, llevé a cabo, del 10 al 19 de marzo 2005, una visita oficial a España con el objeto de preparar el informe sobre el respeto efectivo de los derechos humanos en ese país. Se trataba de mi primera visita oficial de carácter general a Espaňa, pues aquella anterior que, por iniciativa propia, llevé a cabo del 5 al 8 de febrero de 2001, estuvo limitada al País Vasco y tuvo un objetivo específico, a saber, el observar la situación creada por la violación de los derechos humanos como consecuencia de la violencia terrorista (CommDH(2001)2.

• Report by Mr Alvaro Gil-Robles, Commissioner for Human Rights, on the effective Respect for Human Rights in France following his Visit from 5 to 21 september 2005

  Many Europeans see France as the homeland of human rights, and it does in fact provide a high level of human rights protection. It has comprehensive human rights legislation and plays an important part in this area at the international level. Nonetheless, it still has persistent, not to say recurrent, problems - a fact reflected in the many cases brought against it in the European Court of Human Rights. [...] However, I do have the impression that France does not always give itself the resources it needs to operate a relatively full legal arsenal, providing a high level of human rights protection. In some areas, there seems to be a gap - sometimes a very wide one - between law and practice. This general comment applies throughout this report, which discusses France’s main shortcomings in human rights protection and the major challenges facing it today.

  La France, souvent considérée par un grand nombre d’Européens comme la Patrie de Droits de l’Homme, offre en effet un niveau élevé de protection des droits de l’homme. Elle possède une législation complète en la matière et assume un rôle important sur la scène internationale dans ce domaine. La France n’en reste pas moins traversée par des difficultés persistantes, voire récurrentes, ainsi que l’illustre le nombre important d’affaires portées devant la Cour Européenne des Droits de l’Homme. [...] Cependant, j’ai l’impression que la France ne se donne pas toujours les moyens suffisants pour mettre en oeuvre un arsenal juridique relativement complet, qui offre un haut niveau de protection en matière de droits de l’homme. Il semble ainsi exister dans certains domaines un fossé qui peut s’avérer très large entre ce qu’annoncent les textes et la pratique.

  Le Royaume-Uni, qui est l’un des dix membres fondateurs du Conseil de l’Europe, a été le premier pays à ratifier la Convention européenne des droits de l’homme (CEDH) et, suivant le sens très aigu de la liberté individuelle qui caractérise la société britannique, a fait preuve, au cours des dernières décennies, d’un engagement généralement digne d’admiration en faveur du respect des droits de l’homme. L’adoption en 1999 de la loi sur les droits de l’homme (Human Rights Act), qui assure l’applicabilité directe dans le droit interne des droits garantis par la Convention, a constitué un développement extrêmement positif qui a modifié de manière significative le paysage des droits de l’homme au Royaume-Uni.

  One of the ten founding members of the Council of Europe, the United Kingdom was the first country to ratify the European Convention on Human Rights (ECHR) and has, consistently with the strong sense of individual liberty that characterises British society, shown a generally impressive commitment to the respect for human rights over the past decades. The adoption of the Human Rights Act in 1999, rendering the rights guaranteed by the Convention directly applicable in domestic law, has been an extremely positive development and has significantly marked the human rights landscape in the United Kingdom.
