This factsheet reviews the activities of Council of Europe in the field of protection of national minorities, one of the main priorities of Council of Europe. Various legal instruments of Council of Europe are relevant from this respect, such as The European Convention on Human Rights, The Framework Convention for the Protection of National Minorities, The European Social Charter, The European Charter for Regional or Minority Languages.

This human rights factsheet reviews the Council of Europe’s activities concerning combating racism, xenophobia and all forms of discrimination. Combating racism is regarded as an integral part of human rights protection. With the aim to combat racism and intolerance it was established the European Commission against Racism and Intolerance (ECRI). Its activities include country by country monitoring, elaboration of General Policy Recommendations, collection and dissemination of examples of good practices, awareness raising and other activities.

The resolution adopted by the Committee of Ministers on the protection of minorities highlights positive developments such as strengthening the national legislative provisions for combating discrimination, launching initiatives aimed at improving access to social services and the labour market for vulnerable groups, steps taken toward involving Roma in the preparation and implementation of policies that possibly affect them. However, still there are issues of concern, for example problems in the implementation of legislation for combating discrimination. Roma still face discrimination in various areas of social life. The resolution includes also recommendations on minority protection in Spain.

Minority protection is well developed in Sweden. Over the last years, Sweden has taken a number of valuable measures to advance the protection of national minorities. It has developed its institutional capacity to combat discrimination of Roma and other minorities and important public support is given to Finnish and Sami language radio programmes and to other cultural initiatives. Furthermore, a commitment to improve minority protection was made in the National Action Plan for Human Rights (2006-2009) which includes a reference to the Framework Convention’s monitoring findings.

Historically, the State has pledged to protect the rights of its citizens at home – for instance from torture or from exploitation – and of citizens of other states who enter the country lawfully. Where refugees flee persecution at the hands of their own state, international law requires other states to provide the protection denied at home.

Le Comité européen pour la prévention de la torture et des peines ou traitements inhumains ou dégradants (CPT) du Conseil de l’Europe publie aujourd’hui le rapport sur la visite qu’il a effectuée en France du 27 septembre au 9 octobre 2006, ainsi que la réponse du Gouvernement français. Les autorités françaises ont donné leur accord à la publication de ces documents.

What are the rights of the prisoners held by the United States at the base in Guantánamo Bay? Is their imprisonment lawful? Should we be thinking about strengthening the Geneva Conventions and changing international law? The Parliamentary Assembly, and hence the 47 member states of the Council of Europe, has spoken with one voice, condemning this flagrant violation of human rights and demanding the closure of the Guantánamo detention centre.

Quels sont les droits des personnes détenues par les Etats-Unis sur la base de Guantánamo Bay ? Quelle est la légalité de leur détention ? Faut-il s’interroger sur un développement des conventions de Genève et une évolution du droit international ? L’Assemblée parlementaire, et à travers elle les 47 Etats membres du Conseil de l’Europe, a parlé d’une seule voix, dénonçant la violation flagrante des droits de l’homme et demandant la fermeture du centre de détention de Guantánamo.

La Commission européenne contre le racisme et l’intolérance (ECRI) présentera publiquement sa Recommandation sur la lutte contre le racisme et la discrimination raciale dans les activités de la police le jeudi 4 octobre à Paris, au Bureau du Conseil de l’Europe, 55 avenue Kléber 75016 (Métro Boissière).

The Council of Europe has drafted a number of international legal instruments and standards which reflects the importance it attaches to combating terrorism and illustrate the underlying message of the Organisation, which is that it is possible to fight efficiently against terrorism while upholding the basic values that are the common heritage of the European continent.
