• Immigration as an Excuse for much more Security: The Case of Spain

  Roberto Bergalli started his speech describing how Spain discovered only in recent times the real need for tackling the issue of migration. The first Spanish law dealing with the field of immigration was in fact published on July 1st 1985. The ‘Ley Orgánica de Derechos y Libertades de los Extranjeros’ (the Organic Law on Rights and Liberties of Foreigners) regulated some aspects of the social phenomenon of migration. Bergalli stressed how the Spanish word ‘extranjero’ is much more related to the English ‘extraneous’ rather than the word ‘migrant’ underlining the existence of an underground culture of differentiation, separation, when not even exclusion.

  The Spanish transition to democracy, from 1978, has produced a huge number of changes either within the civil society or also inside the political system. It is absolute true that most of theses changes can be seen as completely positive and because this reason Spain is nowadays considered as one of the main members of the European Union. But, in spite of this, geographically speaking Spain belongs to the Euro Mediterranean area which has a particular significance regarding its competences in certain activities concerning the whole Union.

  Roberto Bergalli has been the Head of the Criminology and Criminal Policy Studies of the Universitat of Barcelona. Coordinator of the specialty in "Sociología Jurídico-Penal" of the Doctorate in Law of the Universitat of Barcelona. Director of the European Masters "Penal System and Social Problems" in the Department of Penal Right and Penal Sciences of the Universitat of Barcelona. Co-Director of European MA in Criminology and Criminal Justice. Co-Director of the International Master "Penal Systems Compared and Social Problems" in the Independent University of Mexico (UAM-Azcapotzalco) and Independent University of Hidalgo.

Para ello, el presente volumen contiene diferentes contribuciones, todas las cuales fueron expuestas oralmente en el Seminario sobre Política Criminal de la Guerra que el Observatori del Sistema Penal i els Drets Humans (OSPDH) de la Universitat de Barcelona (UB) tuvo ocasión de organizar.

• Exceptionalism and its impact on the Euro-Mediterranean Relations

  The main objective of this workpackage will be to analyse the impact what exceptional policies have upon liberties and security of European citizens. The goal of this project is to underpin to what extent European States (EU 25) are breaking citizen liberties and security when using emergency policies. This phenomenon has dramatically increased since 11th of September 2001. After this date, we have seen a drastic hardening of the legislation against irregular immigrants, and also that related to international and domestic terrorism, as we can see how the Spanish, the Italian an other Mediterranean countries have enhanced their criminal legislation.
