• What Future for the Area of Freedom, Security and Justice? : Recommendations on EU Migration and Borders Policies in a Globalising World

  The President of the European Commission, José Manuel Barroso, has launched a brainstorming exercise about the future policy priorities for the development of the Area of Freedom, Security and Justice (AFSJ). Migration and borders will constitute two of the most relevant policies on which the next EU budget covering the AFSJ beyond 2013 will be focused.

• A SZABADSÁG ÉS BIZTONSÁG VÁLTOZÓ ÖSSZKÉPE EURÓPÁBAN : A Challange-projekt eredményeiről szóló időközi beszámoló

  A Challange-projekt a jelenlegi liberális kormányok antiliberális joggyakorlatáról alkotott, széles körben elterjedt nézetekre reagál. E gyakorlatok főként a globális mértékben egyre inkább elterjedő biztonság megbomlásból származnak, olyan jelenségekből, melyek széles körben úgy értelmezhetők, mint kötelező intézkedések a hatóságok részéről, következésképpen, mint tulajdonképpeni új korlátok a törvény által biztosított szabadság és az egyén ártatlanságának vélelmének ellenében. A kutats célja olyan ellentmondások vizsgálata, amelyeket azon állítások idéznek elő, miszerint „a biztonság az első számú szabadságjog», ezért új egyensúlyt kell kialakítani, hogy felmérhessük korunk globális veszélyeinek széles skáláját. A projekt első számú tárgya azon irányelvek, illetve veszélyre és megelőzésre hivatkozva kialakított korlátozó intézkedések vizsgálata, amelyek a radikálisan átalakuló környezetben jönnek létre, továbbá ezen intézkedések hatásának vizsgálata a polgári szabadságjogokra, politikai jogokra, illetve a társadalmi kohézióra.

  La question de la collaboration policière européenne est hantée depuis des années par le spectre d’un espace fédéral favorisant la mise en commun des données, avec l’institutionnalisation progressive d’entités policières véritablement supranationales, sorte de FBI européen ; appellation dont on a affublé à certains moments l’OLAF ou/et Europol, soit pour les valoriser, soit pour les discréditer.

• Renseignement, Police et contrôle démocratique : la collaboration européenne et transatlantique

  Les systèmes nationaux articulant les relations entre services de renseignement d’origine militaire ou policière, services de police judiciaire et la justice sont profondément hétérogènes et dépendent de l’histoire nationale de chaque pays, de l’ancienneté de sa démocratie, des relations entre l’exécutif, le législatif et le judiciaire, de la manière dont se mène l’enquête et des règles de procédure devant la justice, ainsi que de l’autonomie (ou non) concédée par les homme politiques aux services de police, et aux services militaires qui font du renseignement. S’y ajoute aussi l’existence ou non d’une communauté nationale du renseignement faisant collaborer les services, et de l’habitude de collaborer à l’échelle internationale avec des services homologues.

• The Changing Landscape of European Liberty and Security: Mid-Term Report on the Results of the CHALLENGE Project

  The CHALLENGE project responds to widespread concerns about the resort to specific illiberal practices by contemporary liberal regimes. These practices are linked with the identification of increasing insecurities globally, insecurities that are widely interpreted as obliging sterner policies from the authorities and, consequently, new constraints on principles of liberty under law and presumptions about the innocence of individuals. Specifically, the project examines tensions created by claims that ‘security is the first freedom’ and that a new ‘balance’ has to be established to manage the global scale of contemporary dangers.

• Intelligence, Police and Democratic Control: European and Transatlantic Collaboration

  The diversified types of relations between intelligence services, judicial police services and judges in Europe, are being considerably transformed by the «war against terrorism». The current trend of a mass-surveillance based on the gathering of mass-intelligence, the interconnection of data-bases and the instantaneous treatment of huge flows of information, destabilizes the fragile balance between intelligence, fundamental rights and democratic control. Indeed, it transforms an ever-growing group of individuals into potential suspects and might thus lead to grave violations of fundamental rights. Moreover, the efficiency of this approach in the quelling of transnational political violence is subject to serious doubt as any data now seems to qualify as intelligence. In this context, the technical dimension of the inter-service and international collaboration in matters of intelligence must not blind the European institutions to their political component. Indeed, the role played by the US administration in the setting of the European intelligence agenda and in the collection and treatment of huge amounts of data concerning European citizens and inhabitants seems to erode the fundamental principle of accountability. Hence, the European institutions should take concrete steps, some of which are suggested in this note, in order to recover a legitimacy that can only be achieved through accountability and to live up to the European standards as far as the democracy, liberty and fundamental rights are concerned. This will also enhance the reliability, accuracy and legitimacy of the intelligence necessary to an effective protection against political violence and arbitrariness.

  Au nom de la protection et de la sécurité nationale, nous semblons à la fois être confrontés à un champ transnational des professionnels de la politique et des professionnels de la sécurité (police, renseignement, militaires). Cette évolution contribue peut-être à rassurer certains, mais elle induit aussi des pratiques illibérales dans les régimes libéraux qui se heurtent à la résistance des juges, des militants des droits de l’homme et d’une partie du public.
