In this article, the legal theorist Luigi Ferrajoli analyses the importance of the relation to the legal order in the differentiation between police-operations and military operations. Whereas police-operations can claim a symbolic superiority on criminal activity (by claiming to act in the name of the law), military operations pre-suppose a symbolic equality and hence a risk of perpetuating the violence because of its inherent incapacity to legitimise its violence.
