This article discusses the arguments in favor of and against a right to mobility. It argues that contemporary migration and border policies are largely restrictive but still fail to meet their proclaimed objectives which call for alternative approaches to international human flows. From a human rights perspective, tight border controls are accompanied by major challenges; including trafficking, the asylum crisis, and the death and vulnerability of irregular migrants; which ultimately threaten the moral foundations of liberal democracies. In this context, a right to mobility may constitute a relevant answer and the article examines the implications of such a right in terms of world justice, social cohesion, economic wealth, security, and border/migration governance.

At its meeting today in Brussels, the 3rd EU-Egypt Association Council has adopted the EU-Egypt Action Plan under the European Neighbourhood Policy (ENP) which will set the agenda for the EU-Egypt cooperation for the next 3-5 years. In a separate decision, the Association Council has established eight sub-committees and one working group, under the EU-Egypt Association Agreement, to follow up the implementation of the Action Plan and to take stock of the progress made. The Action Plan sets out the priorities for co-operation in a wide range of sectors jointly agreed between the EU and Egypt. These are based on Egypt’s own reform agenda in the economic, social and political areas.

Lors de sa réunion d’aujourd’hui à Bruxelles, le 3e Conseil d’association UE–Égypte a adopté le plan d’action UE-Égypte afférent à la politique européenne de voisinage (PEV), qui fixera le calendrier de la coopération entre l’Union européenne et l’Égypte au cours des 3 à 5 années à venir. Dans une décision distincte, le Conseil d’association a constitué, dans le cadre de l’accord d’association UE-Égypte, huit sous-comités et un groupe de travail chargés de suivre la mise en oeuvre du plan d’action et de prendre la mesure des progrès accomplis. Ce plan d’action fixe les priorités en matière de coopération dans un grand nombre de secteurs, arrêtées d’un commun accord entre l’Union européenne et l’Égypte.

The three key objectives of freedom, security and justice are to be developed in parallel and to the same degree of intensity, thus allowing for a balanced approach, based on the principles of democracy, respect for fundamental rights and freedoms and the rule of law.

The CHALLENGE project responds to widespread concerns about the resort to specific illiberal practices by contemporary liberal regimes. These practices are linked with the identification of increasing insecurities globally, insecurities that are widely interpreted as obliging sterner policies from the authorities and, consequently, new constraints on principles of liberty under law and presumptions about the innocence of individuals. Specifically, the project examines tensions created by claims that ‘security is the first freedom’ and that a new ‘balance’ has to be established to manage the global scale of contemporary dangers.

The European Council accordingly stated that the exchange of such information should comply with the conditions applying to the principle of availability. This means that a law enforcement officer in one Member State of the Union who needs information in order to carry out his duties can obtain it from another Member State and that the law enforcement authorities in the other Member State that holds this information will make it available for the declared purpose – taking account of the needs of investigations pending in the latter State.

Biometric controls and other e-security applications are being implemented across the European Union by its member states and border management agencies. Scholars gathered by the Jean Monnet European Centre of Excellence at the University of Leeds to discuss the balance between security and liberty in the age of global terrorism concluded that there is an urgent need to make governments accountable for the use (and potential misuse) of biometric technologies if trust in e-security is to be gained among the citizenry.
