Contributions présentées à une conférence internationale réunie au Trinity College de Dublin, dans le but de permettre un échange de points de vue entre historiens et juristes sur les procès pour crimes contre l’humanité ou génocide qui revêtent aujourd’hui une importance juridique, politique et humaine. Le travail accompli par les Tribunaux pénaux internationaux pour l’ex-Yougoslavie et le Rwanda, mis en place en 1993 et 1994, tout comme la création d’une Cour pénale internationale à la Haye en 2002 ont mis en évidence la portée de ces processus juridiques, à la fois par rapport au droit et aux événements en cause.

The European Council welcomes the enlargement of the Schengen area and the abolition of controls at the internal borders of the Member States participating in the SIS one4ALL project, as from 21 December 2007 for land and sea borders, and by 30 March 2008 for air borders, thus extending the effective free movement of persons.

Durant les dernières décennies du régime soviétique, les difficultés quotidiennes liées à la pénurie de nombreux biens et services ont conduit au développement rapide d’un ensemble de pratiques « souterraines » mais visibles de tous, et considérées comme criminelles dans la législation pénale. Face à la diffusion de ces comportements, comment les policiers et magistrats soviétiques sélectionnaient-ils les affaires qu’ils traitaient au quotidien ?

The framework decisions, as the central legal act under the »third pillar» are some of the most significant non-typical documents from a dogmatic point of view, within the EU law. The differences and specialties of this legislative act, correlated with the EC Treaty are available not only in the lawmaking process, but in juridical supervision as well. The main goal of this paper is to show the dogmatic and practical aspects of these two perspectives.

This conference focuses on the Justice and Home Affairs elements in the European Neighbourhood Policy and in particular those related to the movement of persons. It is the first conference to be organised by the ENEPO project in Brussels. Local organizer is the JHA Unit of CEPS which is also the coordinator of CHALLENGE, another FP6 project dealing with the Area of Freedom, Security and Justice.

Eurojust was set up, following the positive experience of Pro Eurojust, by a Decision of 28 February 2002 (« the Decision ») ; since then it has proved effective in bringing about a real improvement in the operation of law enforcement cooperation between the 27 Member States and has recorded significant operational successes.In the Hague Programme the European Council asked the Commission to consider Eurojust’s further development. Specialists in judicial cooperation met to discuss the issue in Vienna in September 2006 . The European Judicial Network has contributed to the process . Eurojust itself has also made a contribution. In conclusions adopted on 13 June last, the Council once again asked the Commission to present a communication on the role of Eurojust and the European Judicial Network .

Although the Justice and Home Affairs External Dimension (JHAE) has given rise to a growing number of policy documents in recent years, in academia the topic remains largely understudied. This lack of attention stems from the fact that it sits uneasily between two distinct research communities, on the one hand Justice and Home Affairs (JHA) and the other hand, European Foreign Policy (EFP). A further reason is the prevailing view that JHA is first and foremost an internal EU policy, which pursues internal policy objectives.

The Hague Programme invites the Council to consider the «further development of Eurojust», on the basis of a COM proposal. Furthermore, under the Action Plan for the Hague Programme, COM should have presented a proposal for a ’European law’ (on the basis of the Constitution) on Eurojust in 2006. In view of the developments regarding Constitution/Reform Treaty, COM decided to first adopt a Communication on the development of Eurojust and the EJN.

Le Programme de La Haye invite le Conseil à étudier « la suite du développement d’Eurojust », sur la base d’une proposition de la Commission. En outre, conformément au plan d’action du programme de La Haye, la Commission aurait dû présenter en 2006 une proposition de « loi européenne » (en vertu de la Constitution) relative à Eurojust. Compte tenu de l’évolution de la situation en ce qui concerne la Constitution/le traité modificatif, la Commission a décidé d’adopter dans un premier temps une communication sur le développement d’Eurojust et du RJE.

The European Commission has approved a Communication on the role of Eurojust and the European Judicial Network in the context of the fight against organised crime and terrorism. The Communication sets out the Commission’s views on possible improvements. It will be discussed with Member States at a Seminar in Lisbon 29 and 30 October 2007.

La Commission européenne a adopté une communication sur le rôle d’Eurojust et du Réseau judiciaire européen dans le cadre de la lutte contre le crime organisé et le terrorisme dans l’Union européenne. Cette communication présente l’avis de la Commission quant aux améliorations possibles. Elle fera l’objet d’une discussion avec les États membres lors d’un séminaire qui se tiendra à Lisbonne les 29 et 30 octobre 2007.

On 2nd October the United States District Court for the District of Columbia granted a preliminary injunction blocking the transfer of a Guantanamo Bay detainee to Tunisia. The petitioner has been detained in Guantanamo Bay since an undisclosed date. On 15th May 2007 the US Government intended to transfer him out of Guantanamo Bay and to release him to the Government of Tunisia.

A month after the June 2007 European Council reached consensus on the ‘Reform Treaty’ and only a few days after new threats to security were uncovered in the UK, CHALLENGE held its fourth annual conference in Brussels to present its mid-term report and debate what a new institutional framework might mean for justice and security for the EU, its citizens and those who have chosen Europe as their home.

Le deuxiéme rapport bisannuel de la commission nationale Citoyens-Justice-Police, composée de la Ligue des droits de l’Homme, du Syndicat de la Magistrature et du Syndicat des Avocat de France, est rendu public dans un contexte post électoral qui s’avére préoccupant. Au moment où le nouveau président de la République, ancien ministre de l’Intérieur du gouvernement sortant, prend ses fonctions, on ne peut s’empécher d’avoir en mémoire le bilan politique de ces derniéres années en matiére de sécurité publique.

The event included presentations examining the way in which current institutional mechanisms, bodies and procedures applicable to this policy area have an impact on the changing relationship between freedom and security. At the heart of these discussions are the implications of new security policies for individual liberties. The event also served as a forum to present the Mid-Report of the CHALLENGE project gathering its main findings and policy recommendations of the first half of the project’s time span.
