L’année 2008 a encore une fois souligné une activité en pleine croissance pour la CNIL. En 5 ans, le nombre de délibérations adoptées par la CNIL a crû de 765%. Quant aux contrôles, ils ont crû de 1534% sur la même période. Les effectifs ont eux augmenté de 60%.

The Commission submitted the above proposal for a framework decision to the Council on 17 November 2007 and presented its contents to the Multidisciplinary group on organised crime (MDG) on 30 November 2007. At the Informal JHA Ministerial meeting on 25-26 January 2008, the Ministers of Interior discussed a number of general questions regarding this Commission proposal. During the Slovenian Presidency three readings of the proposal took place.

In November 2007, the European Commission published a proposal on the use of Passenger Name Record (PNR) data for law enforcement purposes. This proposal is closely related to other instruments obliging air carriers to transmit passenger data to national authorities, including Directive 2004/82/EC and various agreements that were signed with third countries. The establishment of an ‘EU PNR system’ is presented as a tool in the fight against terrorism and organised crime, but will also be used to investigate other crimes and to prevent illegal immigration. The European PNR system raises both practical as legal concerns.

À plusieurs reprises, la commission des affaires européennes a émis de très fortes réserves sur les accords passés entre l’Union européenne et les États-Unis pour le transfert de données concernant les passagers des vols aériens. Elle a souligné les graves insuffisances de ces accords au regard de la protection de la vie privée et des libertés fondamentales. Le Sénat doit exercer une même vigilance sur la proposition présentée en novembre 2007 par la Commission européenne de mettre en place un système PNR au niveau européen.

On 28 February 2008 the Council decided to authorize the Presidency, assisted by the Commission, to open negotiations for an Agreement between the European Union and Australia on the processing and transfer of European Union-sourced passenger name record (PNR) data by air carriers to the Australian Customs Service. Those negotiations have been successful and a draft Agreement has been drawn up.

The European Commission has adopted its second monitoring and evaluation report on the operation of a Common Position that obliges Member States to exchange data about lost and stolen passports with Interpol. The report shows that all Member States now contribute to and search Interpol’s Lost & Stolen Travel Document database.

La Commission européenne a adopté son deuxième rapport de contrôle et d’évaluation de l’application d’une position commune qui oblige les États membres à échanger avec Interpol des données concernant les passeports égarés et volés. Le rapport indique que, désormais, tous les États membres alimentent et consultent la base de données d’Interpol sur les documents de voyage perdus et volés.
