M. Lovro Šturm, ministre slovène de la Justice, et M. Dragutin Mate, ministre slovène de l’Intérieur, participeront, dans le cadre de la troïka présidentielle, à la 8ième réunion du Conseil de partenariat permanent UE–Russie dans le domaine de l’espace commun de liberté, de sécurité et de justice, qui débutera, le 24 avril 2008 à Saint-Pétersbourg, par un dîner de travail et une discussion sur la lutte contre les stupéfiants. Le lendemain, la rencontre se poursuivra à une réunion officielle et se terminera par une conférence de presse.

A recent Eurobarometer survey shows that 64% of EU citizens are concerned about data protection issues and feel that awareness and information on these topics are not yet satisfactory. Data controllers in private companies generally agree that the requirements of the data protection law are necessary in order to guarantee a high level of protection for consumers and the fundamental rights of citizens. However, half of them believe that legislation cannot cope with the increasing amount of personal information being exchanged.

Une enquête Eurobaromètre récente montre que 64 % des citoyens européens sont préoccupés par les questions de protection des données et qu’ils estiment que la prise de conscience et les informations dans ce domaine laissent encore à désirer. La plupart des responsables du traitement dans les entreprises privées considèrent qu’il faut des normes légales de protection des données pour garantir un niveau élevé de protection des consommateurs et les droits fondamentaux des citoyens. Toutefois, la moitié d’entre eux pensent que la législation ne peut faire face au volume croissant d’informations personnelles échangées.

National laws on data protection demand good data management practices on the part of the entities that process data: the «data controllers». These include the obligation to process data fairly and in a secure manner, and to use personal data for well-defined and legitimate purposes. National laws also guarantee a series of rights for data subjects.

The complaint challenging the German data retention law in front of the Federal Constitutional Court in Karlsruhe has become the biggest constitutional case in German history with the submission of more than 34000 signatures backing up the action. The Working Group on Data Retention has also prepared an amicus curiae brief that it wants to submit to the European Court of Justice in the case Ireland vs. the Data Retention Directive and that can be signed by other NGOs.

The European Commission’s proposals for a European Border Management Strategy are based on an almost blind faith in the use of large-scale databases, identification measures and biometrics for immigration and border control purposes. Yet these measures entail a risk to the protection of not only the right to privacy and the right to data protection, but also to the freedom of movement and the principle of non-discrimination.

In this Opinion the Working Party identifies a clear set of responsibilities under the Data Protection Directive (95/46/EC) for search engine providers as controllers of user data. As providers of content data (i.e. the index of search results), European data protection law also applies to search engines in specific situations, for example if they offer a caching service or specialise in building profiles of individuals. The primary objective throughout the Opinion is to strike a balance between the legitimate business needs of the search engine providers and the protection of the personal data of internet users.

After 30,000 Germans filed a class-action suit, Germany’s constitutional court in Karlsruhe blocked large parts of a new data-collection bill lawmakers say will help stop terror attacks. Opponents say it goes too far. A court in Karlsruhe unplugged a new German data-collection law that would have allowed the government easy access to phone and internet records. Germany’s highest court has dramatically limited the scope of a German data-collection law which politicians said would help prevent terrorist attacks.

The EDPS welcomes the introduction of exemptions from giving fingerprints based on the age of the person or his/her inability to provide fingerprints. These exemptions are part of the fallback procedures that should be implemented. However, the EDPS still considers these exemptions as insufficient to remedy the imperfections of biometrics, such as the impact of misidentification or failure to enrol.

Under the Chairmanship of Dragutin Mate, President of the Justice and Home Affairs Council, the EU interior ministers discussed, during a working lunch at Brdo pri Kranju, the development of the second-generation Schengen Information System (SIS II) and the Proposal for a Council Framework Decision on the use of airline Passenger Name Record (PNR) for law enforcement purposes, which had been put forward by the European Commission in November 2007.
