A delegation of American CIA and FBI agents were in Morocco to examine the terrorist network of Belgian-Moroccan terrorist and informant Abdelkader Belliraj. US interest in Belliraj is based on a connection between him and al-Qaeda and Hezbollah. Meanwhile, the Belgian police delegation has returned from Morocco and convinced of Belliraj’s significance in the network, and may be responsible for more incidents of terrorism than initially presumed.

The Committee of the Regions, ECOS Commission and the FRA will launch jointly on 3rd March 2008, a new report «Community Cohesion at local level: addressing the needs of Muslim Communities». The meeting will introduce the report, will present the work of the Local Communities network (LCN) and will provide a discussion forum for topics highlighted in the Report. This publication aiming at policy makers and practitioners will provide a number of examples of good practice or initiatives at the local level from across European cities.

The Council reached an agreement on two issues regarding a proposal for a Council decision establishing the European Police Office (Europol): the lifting of immunity for Europol officials when participating in operational activities, especially Joint Investigation Teams (JIT), and the principle of staff rotation and the possibility for Europol staff to participating in JIT to receive instructions from the team leader. The presidency announced its intention of reaching a political agreement on this text in April 2008.

The Dutch organisation of municipalities VNG has criticised the anti-terrorism measures put forward in a Bill by Home Affairs Minister Remkes. The proposed measures are directed against persons who are associated with terrorism, but against whom no measures can be taken in criminal law. The VNG fears that the Bill will have a counterproductive effect, because it will lead to stigmatisation. The umbrella organisation also criticises the Bill, because it puts all power in the hands of the Home affairs Minister, who can apply sanctions to a person, without prior deliberation of the municipality of residence of the person concerned. The VNG also questions the dubious structure of the proposal. Someone can challenge the measures taken against him, such as a duty to report oneself at the local police station, or a prohibition to enter certain locations, in Court, but judges will often have too little information to reach a verdict. Staff members of the Domestic Security Service, for example, are not allowed to disclose information when called as a witness.

Op 30 januari heeft de minister voor Vreemdelingenzaken en Integratie een voorontwerp (met memorie van toelichting) gepubliceerd van een Wet houdende aanvullende maatregelen inzake het verblijf in Nederland van Antilliaanse en Arubaanse risicojongeren en inzake inburgering van Antilliaanse en Arubaanse Nederlanders. Inmiddels is dit voorstel voor advisering door de ministerraad naar de Raad van State gezonden. Dit is de voorlopige uitkristallisering van een reeks nogal problematische voorstellen met betrekking tot een inburgeringsplicht voor buiten het land Nederland geboren Nederlanders die zich in Nederland willen vestigen.

In a letter of 24 February 2006 to the Dutch Parliament, the Dutch minister of Government Reform and Kingdom Relations, Alexander Pechtold, has confirmed his earlier plans of setting up a central administration of passports and other travel documents (TK 2005-2006, 25764, nr. 29). Minister Pechtold expects to put forward a bill proposing both the centralisation of the administration of travel documents and the incorporation of fingerprints in the system of the administration of these documents in the autumn of 2006.

As of 15 March 2006, the civic integration examination abroad has been put into use for certain foreign nationals wishing to come to the Netherlands for a prolonged period. People wishing to form a family with someone in the Netherlands, who wish to be reunited with family members already living in the Netherlands, and religious leaders coming to the Netherlands for employment, are required to pass the test before they can issue a temporary stay mvv visa. Persons of a certain nationality, such as EU citizens and persons of American or Japanese nationality, are exempted from this duty.

In the annual report on 2004, the Dutch Data Protection Authority strongly opposes the wide spread opinion that the protection of privacy would prevent an effective fight against terrorism, fraud or prevention of other criminal facts. The protection of personal data is one of the cornerstones of a free, democratic, and safe society, according to mr. Kohnstamm who is the chairman of the Data Protection Authority since September 2004.

In his inaugural lecture of 23 March 2005 at the Vrije Universiteit in Amsterdam, Kuijer argues that in the fight against terrorism, a balance should be made between the right of protection against terrorism (fight against terrorism) and other human rights such as privacy, freedom of religion, freedom of speech, etc) to assess which right should dominate. This duty of balancing rights does however not apply to absolute human rights such as the prohibition of torture: as the protection of these rights should always be put before the fight against terrorism.

In a letter of 10 June 2005, the Ministers of Justice and Interiors report on the progress of the fight against terrorism in the Netherlands. According to the government, it would be necessary to extend the powers of officials in the fight against terrorism. A new proposal on the prevention, pursuit, and prosecution of terrorist crimes has been send for advice to the Dutch Council of State.

In a letter of 18 March 2005, the Minister of Interiors informs the Dutch Parliament on the practice of the so-called CT Infobox. According to the Minister, this CT Infobox is not a central information point accessible to everyone searching information in the fight against terrorism. The Minister describes the result of the actual practice as ‘promising’ and in accordance with the expectations of the participating organisations.
