  • Prüm Treaty will allow EU27 to exchange DNA data to fight crime

    The application of the Prüm Treaty, signed on 27 May 2005 by seven EU countries, should facilitate the exchange of data from DNA and fingerprint databases to produce «a stepping up of cross-border cooperation, particularly in combating terrorism, cross-border crime and illegal migration», according to a report by Fausto CORREIA (PES, PT) and adopted by the European Parliament.
  • Visa Information System (VIS): The JHA-Council reaches a political agreement on the VIS Regulation and VIS Decision

    Today the Justice and Home Affairs Council reached a political agreement on the legislative package on the Visa Information System (VIS): the VIS Regulation and the VIS Decision. The European Parliament adopted this package on 7 June. The adoption of these instruments by the Parliament and the political agreement by Member States are necessary for the further development of the system for the exchange of visa information between Member States. The VIS Regulation will allow consulates and other competent authorities to start using the system when processing visa applications and to check visas. The VIS Decision will allow police and law enforcement authorities to consult the data under certain conditions that ensure a high level of data protection.

    Le Conseil « Justice et Affaires intérieures » a conclu aujourd’hui un accord politique sur le train de mesures législatives relatives au système d’information sur les visas (VIS), à savoir le règlement et la décision VIS. Le Parlement européen avait adopté ces mesures le 7 juin. L’adoption de ces instruments par le Parlement et l’accord politique réalisé par les États membres sont nécessaires pour poursuivre le développement du système d’échange d’information sur les visas entre les États membres. Le règlement VIS permettra aux consulats et à d’autres autorités compétentes d’utiliser le système lors du traitement des demandes de visa et pour contrôler les visas. La décision VIS permettra à la police et aux services répressifs de consulter les données, dans des conditions déterminées qui garantiront un degré de protection élevé.

    Proceedings were begun by a welcome from Dr Judit Tóth, the chair of the first session, on behalf of the Minority Studies Institute, the Hungarian section of the Challenge Consortium, which is made up of 23 international research institutes. The Consortium concentrates on the changing landscapes of European liberty and security issues, and this conference was to address some of the issues brought up by the enlargement of the EU and the interactions between its various members, and those countries on its borders.

    Although a majority of the Member States has ratified the draft Constitutional Treaty, which would provide a clear new institutional framework for the EU, its future has just been resolved at the end of June. The construction of an Area of Freedom, Security and Justice represents an important example where an improved institutional framework is desirable not only to improve coherency and transparency of the decision-making processes, but also in order to enhance the degree of democratic control and judicial accountability applying to these policies.

    Early in 2007, the European Commission published its Annual Policy Strategy for 2008 in which it presents proposals for key initiatives to be taken forward in the next year and assesses their financial and human resource implications. The document presages a profound, long-term impact in the Area of Freedom, Security and Justice in the EU (AFSJ). A new paper by CEPS Research Fellows Sergio Carrera and Florian Geyer offers a critique of the envisaged programme in two main areas: 1) «Fighting Organised Crime and Terrorism» and 2) «Freedom of Movement and Managing the EU’s External Borders».
  • EU visa information system to help prevent visa shopping

    The Civil Liberties Committee approved on Monday a regulation setting up a database for exchange of data between Member States on short-stay visas and visa applications from third country citizens who wish to enter the EU’s Schengen area. The text is the result of an agreement with Council so the legislative process should be completed at the first reading stage after the full Parliament votes on the regulation in June.

Fruit d’un accord avec le Conseil, ce texte devrait être approuvé en plénière en juin prochain, clôturant ainsi la procédure législative dès la première lecture.

  • Towards a comprehensive European Migration Policy: Cracking down on employment of illegal immigrants and fostering circular migration and mobility partnerships

    The European Commission is determined to tackle the pull factor for illegal immigrants created by employers providing illegal work. Today it presented a proposal for a Directive on sanctions against such employers. This is part of a comprehensive European Migration policy which supports legal migration, fights illegal migration, builds cooperation with Third Countries and works with the development agenda. Two Communications on the external dimension of migration were also published today.

    La Commission européenne, déterminée à lutter contre le facteur d’attraction de l’immigration clandestine que constituent les emplois illégaux proposés par certains employeurs, a présenté aujourd’hui une proposition de directive prévoyant des sanctions à l’encontre de ces employeurs. Celle-ci s’inscrit dans le cadre d’une politique européenne globale en matière de migrations, dont l’ambition est de soutenir l’immigration légale, de lutter contre l’immigration clandestine, de développer la coopération avec les pays tiers et de travailler en synergie avec la politique en matière d’aide au développement. Deux communications, relatives à la dimension externe des migrations, ont également été publiées aujourd’hui.

  • Applying the Global Approach to Migration to the Eastern and South-Eastern Regions Neighbouring the European Union

    In December 2005, the European Council adopted the Global Approach to Migration, which brings together migration, external relations and development policy to address the broad migration agenda in an integrated, comprehensive and balanced way in partnership with third countries. It initially focused on Africa and the Mediterranean region. In its Conclusions of December 2006, the European Council called on the Commission «to make proposals on enhanced dialogue and concrete measures» with regard to applying the Global Approach to the Eastern and South-Eastern regions neighbouring the EU.

    Nel dicembre 2005 il Consiglio europeo ha adottato un approccio globale alla migrazione, che associa la problematica migratoria alle relazioni esterne e alla politica dello sviluppo per affrontare il vasto programma della migrazioni in maniera integrata, globale ed equilibrata in partenariato con i paesi terzi. L’approccio interessava inizialmente l’Africa e l’area mediterranea. Nelle conclusioni del dicembre 2006, il Consiglio europeo ha invitato la Commissione a «presentare proposte sul dialogo rafforzato e misure concrete» per quanto riguarda l’applicazione dell’approccio globale alle aree orientali e sudorientali vicine all’Unione europea.
  • Application de l’approche globale sur la question des migrations aux régions bordant l’Union européenne à l’Est et au Sud-Est

    En décembre 2005, le Conseil européen a adopté l’approche globale sur la question des migrations, qui regroupe les politiques en matière de migration, de relations extérieures et de développement, afin de traiter les multiples questions liées aux migrations en adoptant une approche cohérente, globale et équilibrée dans le cadre de partenariats avec des pays tiers. À l’origine, elle était principalement centrée sur l’Afrique et la région méditerranéenne. Dans ses conclusions de décembre 2006, le Conseil européen a appelé la Commission à « faire des propositions sur le dialogue renforcé et sur des mesures concrètes » concernant l’application de l’approche globale aux régions bordant l’Union européenne à l’Est et au Sud-Est.
  • A Comprehensive European Migration Policy

    The comprehensive EU migration policy, as defined by the European Council, provides a coherent and efficient manner to respond to the challenges and opportunities related to migration. It builds on the conclusions of the Tampere European Council in 1999, the Hague Programme of 2004 and the Global Approach to Migration adopted by the European Councils in 2005 and 2006. This comprehensive approach involves all stages of migration, aims to harness the benefits of legal migration and covers policies to fight illegal migration and trafficking in human beings. It is based on the general principles of subsidiarity, proportionality, solidarity and respect for the different legal systems and traditions of the Member States. It is also based on respect for human rights and fundamental freedoms of migrants, the Geneva Convention and due access to asylum procedures.

  • EU: Common Criminal Provisions Against Racism and Xenophobia

    The Council of EU Justice Ministers in Luxembourg today achieved political agreement on a Framework Decision on combating racism and xenophobia. This allowed the negotiations at the European level, underway since 2001, to be successfully concluded under the German EU Presidency. «Europe is determined to forcefully defend its common values and to rigorously punish those who treat these values with contempt for humanity. In the future, there will be binding minimum harmonisation throughout Europe of the provisions on criminal liability for disseminating racist and xenophobic statements. Public incitement to violence and hatred, as well as the denial or gross trivialisation of genocide out of racist or xenophobic motives, will be sanctioned across Europe. With this, we are sending a clear signal against racism and intolerance,» stressed Brigitte Zypries, Chair of the EU Council of Justice Ministers.
