    Depuis les attentats du 11 septembre 2001 à New York, la « guerre contre le terrorisme » est déclarée au niveau international. L’ennemi désigné est Al-Qaida et son chef Oussama Ben Laden. Mais la netteté apparente de cette cible recouvre des réalités multiples : réseaux de cellules, camps d’entraînement, affidés inconditionnels, simples sympathisants, idéologues, sur tous les continents et dans toutes les classes sociales.

    The U.S. detention facility at Guantánamo Bay has become a stain on the United States’ reputation. Shutting it down will cause new problems. Rather than hold terrorism suspects in preventive detention, the United States should turn them over to its criminal justice system.

The author shows that this policy is unable to stop the structural inequality of the welfare system and even concludes that these arguments underestimate the impact of privatization on afro-american families, while overlooking the full range of Social Security program benefits that are much more important to these group of citizens

La proposition implique des obligations pour les transporteurs aériens de transmettre des données sur tous les passagers des vols à destination ou au départ d’un État membre de l’Union européenne.

    The Special Rapporteur on the promotion and protection of human rights and fundamental freedoms while countering terrorism, Martin Scheinin, visited the United States of America from 16 to 25 May 2007, during which he met with senior officials of the Government, members of Congress and their staff, academics and non-governmental organizations, as well as with the Inter-American Commission on Human Rights. The objective of the visit was to undertake a fact-finding exercise and a legal assessment of United States law and practice in the fight against terrorism, measured against international law. His visit also aimed at identifying and disseminating best practice in the countering of terrorism.

  • Governments should Take Positive Steps to Protect Housing Rights of Roma in Europe, UN and Council of Europe Experts Say

    The Council of Europe’s Commissioner for Human Rights, Thomas Hammarberg and the Special Rapporteur on the right to adequate housing of the United Nations Human Rights Council, Miloon Kothari in their press release from 24 October 2007 stated that the housing rights of Roma are violated in several countries of Europe. The "rate and number of forced evictions of Roma have grown dramatically, and segregation and ghettoization in the housing field appears to have intensified and become entrenched in recent years". The experts called on the governments to take positive measures in order to protect the housing rights of Roma in Europe.
  • US Court blocks transfer of Guantanamo detainee to Tunisia for threat of torture

    On 2nd October the United States District Court for the District of Columbia granted a preliminary injunction blocking the transfer of a Guantanamo Bay detainee to Tunisia. The petitioner has been detained in Guantanamo Bay since an undisclosed date. On 15th May 2007 the US Government intended to transfer him out of Guantanamo Bay and to release him to the Government of Tunisia.
  • US Supreme Court refuses to hear El-Masri Case

    On 9th October 2007 the US Supreme Court refused to hear an appeal filed on behalf of the German citizen of Lebanese descent Khaled el-Masri. He claims to have been abducted by US agents and then tortured by them while imprisoned in Afghanistan. The fate of Mr el-Masri has been subject to intensive scrutiny in the investigations of the Council of Europe and the European Parliament on the involvement of European authorities in CIA activities on European territory. Represented by the American Civil Liberties Union (ACLU) Mr el-Masri had brought a lawsuit in US federal courts against George Tenet, director of the CIA from 1997 to 2004, seeking damages for illegal treatment.

    The new EU–US Agreement on the processing and transfer of Passenger Name Record (PNR) data, signed at the end of July 2007, is now published in the Official Journal No. L 204 of 4.8.2007, p. 18. The Council decision, approving the signing of the agreement as well as an exchange of letters between the EU and the US is published in the same volume.

    The Passenger Name Record (PNR) is the generic name given to the files created by the airlines for each journey any passenger books. They are stored in the airlines’ reservation and departure control databases. PNR allows all the different agents within the air industry (from the travel agent and the computer reservation systems (CRS) to the carrier and the handling agents at the airports) to recognise each passenger and have access to all relevant information related to his/her journey: departure and return flights, connecting flights (if any), special services required on board the flight, etc.
