  Security concerns and the tension between the movement of human capital and the will of welfare states to control migration at their borders have led the European Union to set extra-territorial zones of detention for the purpose of border control in the last 20 years. Practices of control over the movement of people have thus created contested spaces of sovereignty at the borders, populated by a «floating population» of asylum seekers and undocumented migrants to be deported.

Dans l’environnement on a beaucoup utilisé de le terme de précaution et on a mis en place une réflexion épistémique et théorique sur la validité du concept et sur ce qu’il implique en terme de politique publique.

Elle a souligné les graves insuffisances de ces accords au regard de la protection de la vie privée et des libertés fondamentales. Le Sénat doit exercer une même vigilance sur la proposition présentée en novembre 2007 par la Commission européenne de mettre en place un système PNR au niveau européen.

• Contrôle du STIC : Les propositions de la CNIL pour une utilisation du fichier plus respectueuse du droit des personnes

  C’est la première fois que la CNIL contrôle le fonctionnement du STIC. Ce contrôle constitue un enjeu essentiel dans la mesure où les conséquences pour les personnes peuvent être très importantes dans le cadre d’enquêtes administratives (perte d’emploi, refus d’embauche) qui concernent 1 million d’emplois. Lors de ces contrôles, la CNIL s’est intéressée à la façon dont les services de police utilisent le STIC mais aussi à la transmission des suites judiciaires qui incombe aux procureurs de la République pour la mise à jour, voire l’effacement, des données dans ce fichier. Ce contrôle a permis de constater, très concrètement, des problèmes souvent liés à une inadéquation entre les moyens mis en oeuvre par les ministères et les objectifs assignés à ce grand fichier de police. La CNIL formule 11 propositions pour que l’utilisation du STIC soit mieux contrôlée et plus sécurisée de façon à ce que les informations qui le constituent soient parfaitement exactes et mises à jour

  La loi n° 2006-64 du 23 janvier 2006 relative à la lutte contre le terrorisme et portant dispositions diverses relatives à la sécurité et aux contrôles frontaliers (LAT) apporte la réponse la plus opérationnelle possible à la menace terroriste, tant dans le domaine de la prévention qu’en matière de répression des actes de terrorisme. Elle vise également à contribuer à l’efficacité du dispositif de sécurité afin de concourir à la préservation de l’ordre public et à l’amélioration des contrôles frontaliers. Elle comporte donc, à ce titre, certaines dispositions qui concernent la police administrative et d’autres, la répression des actes du terrorisme.
