    The Spanish concept of terrorism has evolved in a quite particular meaning. The identification of ETA (Basque Liberation Army) as the internal enemy has concentrated the use of every antiterrorist law and criminal justice agencies addressed to call a halt its activities. A number of criminal and procedural rules, police and prison regulations have been modified in Spain by following the antiterrorist philosophy.

  • The last peace process in the basque country: 14 months of hope

    The present work shows the genesis and development of the last peace process that took place in the Basque Country from March, 2007, in the frame of antiterrorist excepcionalism. The paper focus on the origins of the Basque conflict - outlining the history of the movement ETA- and in the influence that both the diverse actors and a part of the Spanish written press (the newspapers El País, El Mundo and Gara) have had in the development of the events.

    The Area of Freedom, Security and Justice (AFSJ) constitutes one of the policies which will be more affected by the new institutional configurations that will be brought about by the Reform Treaty signed in Lisbon on the 13 December 2007 (Treaty of Lisbon). These policies, traditionally denominated as Justice and Home Affairs, have been subject to various criticisms calling for the need to reform and improve their current institutional, legal and procedural structures.

    This study is a response to the European Parliament’s desire to better understand and to improve the detention and reception conditions for third country nationals in closed and open centres in Europe, with special consideration for persons with special needs. It assesses the implementation of the standards outlined in part II of the Reception Conditions Directive 2003/9/CE (22/01/2003). The unique feature of this study is that it focuses on vulnerable groups and assesses whether their needs are taken into account or not and if the conditions found in Europe contribute to an improvement in, or the aggravation of, their situations of vulnerability.

    The proposed amendment of the 2002 Framework Decision on combating terrorism further increases the impression of a «(in)security continuum» that could be used as an argument for the criminalization of otherwise legal behaviours; these behaviours could, most importantly, be regarded as forms of exercise of such fundamental freedoms as the freedom of expression. In fact, the main problem of the new offences to be created is the inadequate treatment of the rivalry between freedoms that they involve, by virtue of the abstract definitions and subjective criteria that are proposed to national legislative authorities, an element that ultimately poses a threat to the rule of law.

    Reprieve welcomes the Scottish parliament’s decision to fully investigate the alleged use of Scottish airports to support the CIA’s illegal programme of enforced disappearance, illegal transfer and torture of prisoners in the ‘war on terror.’. Transfers to torture deprive the individual of their most basic human rights and subject them to the cruellest abuse. Many victims of rendition have simply disappeared, as documented by a recent report (‘Off the Record’) by Reprieve and five other major human rights groups.

    A new discussion on the legality and legitimacy of shooting down a hijacked passenger plane that might be used to attack objects on the ground was sparked last week (16.9.-21.9.2007) in Germany. It started with a statement of German Minister of Defense, Franz Josef Jung that he would have to order such a shooting in the worst case scenario relying on the concept of a ‘supra-legal state of emergency’ .

    Etude de la création et des usages de la loi d’état d’urgence entre 1955 et 2005. Cette loi porte la marque de la guerre d’Algérie, pendant laquelle elle a été élaborée et modifiée. L’état d’urgence fut déclaré 5 fois : en Algérie en 1955, en France en 1958, puis de 1961 à 1963, en Nouvelle-Calédonie en 1985, puis de nouveau en France en 2005. Alors qu’elle est souvent dénoncée comme une loi coloniale, c’est pendant la période gaulliste qu’elle connut sa durée d’application la plus longue et la moins contrôlée.

    Workpackage 1 organised a one-day workshop in London to bring together practitioners and academics from multiple disciplines including law, government, international relations, political science, sociology and media studies. The aim was to discuss recent transformations in the field of counter-terrorism and their social, legal and political implications. It was attended by 40 people from universities and institutions across the UK and Europe. The day was organised around three thematic panels on the legal implications of counter-terrorism and extraordinary rendition for the EU; the political-theoretical implications of recent transformations in counter-terrorism and practices of exceptionalism; and finally on the social implications of counter-terrorism with regard to the media, globalisation and human rights.
