This ad hoc briefing paper offers an up to date account of the implications of the European Neighbourhood Policy (ENP) in justice and home affairs. It does so in three ways: First, it provides a comprehensive presentation of the provisions on common management of borders, control of illegal migration and visa policy. Second, the paper discusses the content and effects of EU policies and tools as they related to border controls. Third, and finally, the paper weights the power of the European Parliament in the fields discussed, by focusing on readmission agreements. Each chapter offers a set of policy recommendations.

This report is based on the speeches and discussions held at the Our Voices Heard – Amare Glasura Ashunde – a Romani Women’s Rights Conference that was organized by the Swedish Ministry of Integration and Gender Equality, the Council of Europe and the European Union Agency for Fundamental Rights in December 2007 in Sweden.
The themes addressed in the report include combating social exclusion, multiple discrimination of Romani women, Romani woman’s rights, combating trafficking, equal access to public health care and respecting reproductive rights.

A recent Eurobarometer survey shows that 64% of EU citizens are concerned about data protection issues and feel that awareness and information on these topics are not yet satisfactory. Data controllers in private companies generally agree that the requirements of the data protection law are necessary in order to guarantee a high level of protection for consumers and the fundamental rights of citizens. However, half of them believe that legislation cannot cope with the increasing amount of personal information being exchanged.

La plupart des responsables du traitement dans les entreprises privées considèrent qu’il faut des normes légales de protection des données pour garantir un niveau élevé de protection des consommateurs et les droits fondamentaux des citoyens. Toutefois, la moitié d’entre eux pensent que la législation ne peut faire face au volume croissant d’informations personnelles échangées.

National laws on data protection demand good data management practices on the part of the entities that process data: the «data controllers». These include the obligation to process data fairly and in a secure manner, and to use personal data for well-defined and legitimate purposes. National laws also guarantee a series of rights for data subjects.

The complaint challenging the German data retention law in front of the Federal Constitutional Court in Karlsruhe has become the biggest constitutional case in German history with the submission of more than 34000 signatures backing up the action. The Working Group on Data Retention has also prepared an amicus curiae brief that it wants to submit to the European Court of Justice in the case Ireland vs. the Data Retention Directive and that can be signed by other NGOs.

The resolution adopted by the Committee of Ministers on the protection of minorities highlights positive developments such as strengthening the national legislative provisions for combating discrimination, launching initiatives aimed at improving access to social services and the labour market for vulnerable groups, steps taken toward involving Roma in the preparation and implementation of policies that possibly affect them. However, still there are issues of concern, for example problems in the implementation of legislation for combating discrimination. Roma still face discrimination in various areas of social life. The resolution includes also recommendations on minority protection in Spain.

The European Commission’s proposals for a European Border Management Strategy are based on an almost blind faith in the use of large-scale databases, identification measures and biometrics for immigration and border control purposes. Yet these measures entail a risk to the protection of not only the right to privacy and the right to data protection, but also to the freedom of movement and the principle of non-discrimination.

Ce document préconise, notamment, le renforcement des droits des personnes en attribuant à la CNIL le contrôle de tous les systèmes de vidéosurveillance, quel que soit leur lieu d’implantation (lieu privé ou lieu public)

In this Opinion the Working Party identifies a clear set of responsibilities under the Data Protection Directive (95/46/EC) for search engine providers as controllers of user data. As providers of content data (i.e. the index of search results), European data protection law also applies to search engines in specific situations, for example if they offer a caching service or specialise in building profiles of individuals. The primary objective throughout the Opinion is to strike a balance between the legitimate business needs of the search engine providers and the protection of the personal data of internet users.

Par ce rapport annuel, remis au Président de la République et au Parlement, la Commission nationale de déontologie de la sécurité présente les résultats de son activité au cours de l’année 2007, ainsi que les conditions de son fonctionnement. Émanant de parlementaires (sénateurs ou députés) et d’autorités administratives indépendantes (Défenseur des enfants, Médiateur de la République, Président de la HALDE), les saisines transmises à la Commission aboutissent, après l’étude des faits allégués dans les réclamations, à des décisions, avis et/ou recommandations. En 2007, la Commission nationale de déontologie de la sécurité a traité 117 saisines, transmises au cours des années 2005, 2006 et 2007, qui figurent dans ce rapport annuel.

On 13 December 2007 the Lisbon Treaty was signed. Aspects related to the area of freedom, security and justice (AFSJ) will be among the policies most affected by the Reform Treaty. This policy field has been notorious for its inability to respond to its specific challenges under the existing institutional framework and substantial reform been considered urgent. Yet, exactly what will the new setting bring to the area of freedom, security and justice? Will it properly address the weaknesses and flaws of the current framework? In short: Which will be Lisbon’s contribution in the creation of the AFSJ?

In the statement on the occasion of International Roma Day, Anastasia Crickley, Chairperson of FRA’s Management Board emphasised the importance of implementation of anti-discrimination legislation and of programmes and policies that aim to ensure equal opportunity for Roma and Travellers in the Member States of the European Union. FRA welcomes the moves towards greater coordination of EU Member States in combating discrimination against Roma and Travellers and in improving their inclusion.

This briefing note first explains the international human rights law framework relevant to provocation to terrorism and related offences, particularly public provocation, with a focus on freedom of expression. It makes reference to relevant international case law and policy and highlight legislation and cases in selected EU Member States. Minority protection is well developed in Sweden. Over the last years, Sweden has taken a number of valuable measures to advance the protection of national minorities. It has developed its institutional capacity to combat discrimination of Roma and other minorities and important public support is given to Finnish and Sami language radio programmes and to other cultural initiatives. Furthermore, a commitment to improve minority protection was made in the National Action Plan for Human Rights (2006-2009) which includes a reference to the Framework Convention’s monitoring findings.

This paper addresses the issue of the increasing infringement of European football supporters’ civil rights and liberties since the mid-1980s. The analysis of the national and supranational regulation of football hooliganism in the light of the evolution of crime control policies in Europe uncovers that this jeopardising of freedoms, owing to the institutionalisation of the control of deviance and to the blurring of the frontiers between the executive and the legislative powers, is not a side-effect of the counter-hooliganism policies.

The European Court of Human Rights ruled that Italy would violate its obligations under the European Convention of Human rights if it deports Nassim Saadi, a Tunisian terror suspect from Italy, citing the very real risk of torture if he were to return to his home country. Human rights group Amnesty International applauded the ruling, as a «landmark» ruling on the absolute prohibition of torture, inhuman, and otherwise degrading treatment.
