• Islamists are the main terror threat, says report

  The Italian government investigated 216 terror threats against Italy last year, concluding that Islamist cells were the «primary threat to the public interest, both Italy and abroad.» The extent of the terror threats were revealed in an anti-terrorism report presented to the department of information security.

• Acquittals of Islamists raise security concerns in Spain

  Spain’s National Court acquitted three Islamist extremists suspected of helping to finance al Qaeda. The acquittal is raising questions over the country’s law and judicial systems. Recently acquitted Imad Eddin Baraka Yarkas, known as Abu Dahdah, who is serving a 12 year sentence on a separate charge of having headed in al Qaeda cell in Spain, was initially sentenced to an additional 15 years for helping to organize the attacks on 9/11.

  A link between terrorism plots and hardcore child pornography is becoming clear after a string of police raids in Britain and across the Continent, an investigation by The Times has discovered. Images of child abuse have been found during Scotland Yard antiterrorism swoops and in big inquiries in Italy and Spain. Secret coded messages are being embedded into child pornographic images, and paedophile websites are being exploited as a secure way of passing information between terrorists.

  La loi n° 2006-64 du 23 janvier 2006 relative à la lutte contre le terrorisme et portant dispositions diverses relatives à la sécurité et aux contrôles frontaliers (LAT) apporte la réponse la plus opérationnelle possible à la menace terroriste, tant dans le domaine de la prévention qu’en matière de répression des actes de terrorisme. Elle vise également à contribuer à l’efficacité du dispositif de sécurité afin de concourir à la préservation de l’ordre public et à l’amélioration des contrôles frontaliers. Elle comporte donc, à ce titre, certaines dispositions qui concernent la police administrative et d’autres, la répression des actes du terrorisme.

Dans le même temps, personne ne parle de Cristina, un autre fichier, bien plus problématique.

  Today the Council reached a common approach on the amendment of the Framework Decision on combating terrorism proposed by the Commission on 6 November 2008. The amendment up-dates the Framework Decision making public provocation to commit a terrorist offence, recruitment and training for terrorism punishable behaviour, also when committed through the Internet. The amendment is well-balanced in terms of its effects on freedom of speech and general respect for human rights.

• Modification de la décision-cadre du Conseil relative à la lutte contre le terrorisme

  Aujourd’hui, le Conseil a arrêté une position commune sur la modification de la décision-cadre relative à la lutte contre le terrorisme, proposée par la Commission le 6 novembre 2008. La modification actualise la décision-cadre en rendant passibles de poursuites la provocation publique à commettre des infractions terroristes ainsi que le recrutement et l’entraînement à des fins de terrorisme, y compris par Internet. La modification est équilibrée quant à ses effets sur la liberté d’expression, comme en termes de respect des droits humains en général.

• German constitutional challenge on Data Retention

  The complaint challenging the German data retention law in front of the Federal Constitutional Court in Karlsruhe has become the biggest constitutional case in German history with the submission of more than 34000 signatures backing up the action. The Working Group on Data Retention has also prepared an amicus curiae brief that it wants to submit to the European Court of Justice in the case Ireland vs. the Data Retention Directive and that can be signed by other NGOs.
