International migration is growing in scope and complexity and has a serious impact – both positive and negative – on the EU and its Member States. The EU’s comprehensive migration policy provides a coherent and efficient way of responding to the challenges and opportunities linked to migration. Over the coming years the EU will need to further expand this comprehensive common migration policy, based on a continuation of the work carried out over the last seven years since Tampere.

The development of an EU framework of the integration of immigrants has been presented as one of the key strategic objectives for the development of an Area of Freedom, Security and Justice. Based on the Amsterdam Treaty, and the political mandates given by the Tampere and The Hague Programmes, the European Commission has presented in the last years a series of instruments addressing the area of «integration of immigrants», and intending to consolidate a common European framework for action.

Les résultats de ce rapport, qui présente les avancées réalisées dans le domaine de la liberté, de la sécurité et de la justice, montrent la nécessité que la conférence intergouvernementale mette fin à l’incertitude qui entoure la réforme du traité sur l’Union européenne. Le rapport (« tableau de bord ») couvre l’année 2006 et le bilan global qu’il établit est mitigé. Les progrès n’ont pas été constants dans tous les domaines d’action et la transposition des instruments par les États membres n’est pas satisfaisante.

Today, the Commission adopted the second annual report on the implementation of the Hague Programme on achievements in Justice, Freedom and Security policies. The findings support the need for the Intergovernmental conference to end the uncertainty over the European Union’s Treaty reform. The report (« The Scoreboard ») covers 2006 and the overall assessment is mixed. Progress was not consistent in all policy areas and transposition of instruments by Member States is not satisfactory.

On the basis of the Tampere and Hague Programmes significant progress has been made in developing the Union as an area of freedom, security and justice. The European Council stresses the need to continue the implementation of those programmes and to work on the succession to them in order to further strengthen Europe’s internal security as well as the fundamental freedoms and rights of citizens.

The rapid development of Internet and other information systems has given rise to a completely new economic sector and to new rapid flows of information, products and services across the internal and external borders of the EU. This has opened many new possibilities for criminals. A pattern of new criminal activities against the Internet, or with the use of information systems as a criminal tool, is clearly discernible. These criminal activities are in permanent evolution, and legislation and operational law enforcement have obvious difficulties in keeping pace. The intrinsic cross-border character of this new type of crime creates a need for improved cross-border law enforcement cooperation.

The comprehensive EU migration policy, as defined by the European Council, provides a coherent and efficient manner to respond to the challenges and opportunities related to migration. It builds on the conclusions of the Tampere European Council in 1999, the Hague Programme of 2004 and the Global Approach to Migration adopted by the European Councils in 2005 and 2006. This comprehensive approach involves all stages of migration, aims to harness the benefits of legal migration and covers policies to fight illegal migration and trafficking in human beings. It is based on the general principles of subsidiarity, proportionality, solidarity and respect for the different legal systems and traditions of the Member States. It is also based on respect for human rights and fundamental freedoms of migrants, the Geneva Convention and due access to asylum procedures.

Since 2002 it was agreed that the procedure for amendment of the Europol convention should be simplified. Several options have been elaborated. At this moment there is no political consensus on a final decision in how integrating the Europol convention into the European Treaties and its potential transpillarisation, nor on the procedure, neither on its scope. In the short term and without changing the current legal framework it is necessary to urgently implement the three agreed protocols and Europol will need to prepare for the time when these protocols amending the Convention will enter into force. The Hague program has created a new momentum for increased cooperation in the area of freedom, security and justice, and for Europol. A conscientious outlook to future challenges of EU law enforcement cooperation must recognise that it should become easier to adapt Europol’s institutional set up. But in the absence of the Constitutional treaty, some Member States are of the opinion that the legal basis for Europol, including the modalities for changing it, should stay as they are. But it is also clear that other Member States show the willingness to at least explore new modalities and legal frameworks. So the two fundamental questions are:- the legal options of how to amend/replace the Europol convention, and the relationship of any such amendment with the Constitutional Treaty.

Depuis 2002 il est décidé que la procédure d’amendement de la Convention Europol soit simplifiée, et plusieurs options ont été prévues. Il n’y a, pour l’heure, aucun consensus politique sur la décision finale à prendre au sujet de l’intégration d’Europol dans les Traités européens et de la possible transpilarisation, qu’il s’agisse de la procédure ou de l’étendue ce cette intégration. Dans le court terme, et sans changer le cadre juridique actuel, il est nécessaire de mettre rapidement en oeuvre les trois protocoles approuvés. Europol devra par ailleurs se préparer à l’entrée en vigueur effective de ces protocoles. Le programme de La Haye a généré un nouveau dynamisme pour une coopération accrue dans les domaines de la liberté, la sécurité et la justice, ainsi que pour Europol. Une analyse minutieuse des futurs défis de la coopération européenne en termes d’application de la loi doit reconnaître qu’il devrait être plus facile d’adapter les fondements institutionnels d’Europol. Mais certains Etats membres, en l’absence d’un traité constitutionnel, considèrent que les bases légales d’Europol, y compris ses modalités de changement, devaient rester telles quelles. D’autres Etats membres expriment la volonté d’explorer les nouvelles modalités et cadres juridiques possibles. Les deux questions fondamentales sont : les options juridiques permettant d’amender/remplacer la Convention Europol, et les liens de tels amendements avec le Traité constitutionnel.

Efforts to enhance police co-operation in the European Union have been taking place for a number of years now. Successive legislative and constitutional developments have granted the European Union competence to act in the field. Major steps in this context have been: the creation of the third pillar in the Maastricht Treaty and its amendment in Amsterdam; the incorporation of the Schengen acquis in Community/Union law by the Amsterdam Treaty; and the signature and ratification of the Europol Convention and the start of work of Europol in 1999.

Des efforts existent depuis plusieurs années pour améliorer la coopération policière au sein de l’Union européenne. Des développements législatifs et constitutionnels successifs ont offert à l’UE une compétence d’action dans ce champ. Les principaux efforts dans ce contexte ont été : la création du troisième pilier dans le Traité de Maastricht et ses amendements à Amsterdam ; l’incorporation des acquis Schengen dans le droit de la Communauté/Union par le Traité d’Amsterdam ; et la signature et la ratification de la Convention Europol au début d’Europol en 1999.

The framework programmes in the area of Justice, Freedom and Security, under the new Financial Perspectives 2007-2013 have been established to provide coherent support to an area of freedom, security and justice under the financial perspectives 2007 – 2013. The three key objectives of freedom, security and justice are to be developed in parallel and to the same degree of intensity, thus allowing for a balanced approach, based on the principles of democracy, respect for fundamental rights and freedoms and the rule of law.

The European Council accordingly stated that the exchange of such information should comply with the conditions applying to the principle of availability. This means that a law enforcement officer in one Member State of the Union who needs information in order to carry out his duties can obtain it from another Member State and that the law enforcement authorities in the other Member State that holds this information will make it available for the declared purpose – taking account of the needs of investigations pending in the latter State.
